1. Introduction

Welcome to Trust Cloaker. These Terms & Conditions ("Terms") govern your access to and use of our services, website, and any software provided by Trust Cloaker ("Service"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. Using the Service

The Service is provided to businesses and individuals to verify and protect website traffic. You must be at least 18 years old and able to form a binding contract to use the Service. Account registration, where required, must include accurate and complete information.

3. Accounts, Credentials & Security

  • You are responsible for maintaining the confidentiality of account credentials and for all activity under your account.
  • Notify us immediately of any unauthorized use or security breach. We are not liable for losses caused by unauthorized access where you failed to take reasonable care to protect your credentials.

4. Payment, Subscriptions & Refunds

Certain features require payment. Fees, billing cycles, and refund policies are set forth on our Pricing page and in your subscription agreement. You consent to payment processing by our third-party payment providers. We may suspend access for unpaid accounts. Refunds, if any, are provided at our discretion and in accordance with the published policy.

5. Acceptable Use & Prohibited Conduct

You agree not to:

  • Use the Service for unlawful, fraudulent, or malicious activity;
  • Attempt to reverse-engineer, reproduce, or tamper with the Service;
  • Interfere with the operation or security of the Service or other users' accounts.

6. Intellectual Property

All software, content, trademarks, and materials provided by Trust Cloaker are our property or licensed to us. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You retain ownership of content you upload or provide but grant us a license to process and display it as needed to deliver the Service.

7. Privacy

Our Privacy Policy describes how we collect and use personal data. By using the Service you consent to our data practices and processing described in the Privacy Policy.

8. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, error-free, or completely secure operation.

9. Limitation of Liability

Except where prohibited by law, Trust Cloaker and its affiliates, officers, and employees will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunity, even if advised of the possibility of such damages. Our aggregate liability for direct damages will not exceed the total fees paid by you to Trust Cloaker in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Trust Cloaker from claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

11. Termination

We may suspend or terminate your access for violations of these Terms or for business reasons (e.g., non-payment). Upon termination, your license ends and we may delete or retain data in accordance with our data retention policies. Some provisions (intellectual property, disclaimers, limitation of liability, indemnity, and governing law) survive termination.

12. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms or via email. Continued use after changes indicates acceptance of the updated Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws specified in our legal notice (or, if none, by the laws of the jurisdiction where Trust Cloaker is incorporated), without regard to conflict of laws principles. Disputes will be resolved in competent courts of that jurisdiction unless otherwise agreed in writing.

14. Third-Party Services

The Service may integrate with third-party tools and services. Those integrations are subject to the third parties' terms; we are not responsible for their performance or policies.
